Vyom Cloud ("we", "us", "our") operates www.vyomcloud.com and provides VPS hosting, cloud hosting, GPU servers, colocation (rack space), dedicated servers, and managed services such as migration, backup, DDoS protection, and workflow automation (the "Services"). This Privacy Policy explains, in plain language, what personal data we collect, why we collect it, how long we retain it, and your rights, in accordance with the Digital Personal Data Protection Act, 2023 (DPDPA) and applicable Indian law. We do not sell your personal data to anyone.

1. Personal Data We Collect

1.2 Information Collected Automatically

  • Technical & network logs — IP addresses, connection logs, bandwidth usage, and server performance metrics, collected to deliver and secure the Services
  • Website usage data — pages visited, browser type, device information, collected via cookies and analytics tools
  • NOC monitoring data — uptime, resource usage, and security event logs generated by our Network Operations Center to detect abuse, DDoS activity, or service issues

1.3 Information From Third Parties

  • Payment gateway providers (transaction status and confirmation)
  • Reseller or partner referrals, where you sign up through an authorized VyomCloud partner

3. How We Use Your Data

  • To provision, configure, and maintain your VPS, dedicated server, cloud server, or colocation account
  • To process payments, generate invoices, and manage renewals
  • To respond to technical support requests and NOC escalations
  • To detect and prevent fraud, abuse, and security incidents affecting our network
  • To send mandatory service notices (maintenance windows, renewal reminders, security alerts) via email, SMS, or WhatsApp
  • To send marketing communication only where you have opted in, and only until you opt out
  • To manage physical access and security at our data center facility, for visitors and colocation clients
  • To comply with legal, tax, and regulatory obligations under Indian law

4. Data Sharing and Cross-Border Transfer

We do not sell your personal data. We share data only with:

  • Payment processors, strictly to complete your transactions
  • Network and infrastructure partners, where necessary to deliver connectivity or bandwidth for your Services
  • Law enforcement or regulators, only where legally required

Where personal data is transferred or stored outside India, we ensure such transfer complies with Section 16 of the DPDPA and is not made to a country restricted by the Central Government.

5. Data Retention

We retain personal data only as long as necessary for the purpose it was collected, or as required by law. As a general practice:

  • Billing and invoice records are retained as required under applicable tax law
  • Support ticket and chat history is retained for a limited period for quality and dispute-resolution purposes, then deleted or anonymized
  • Server/network logs are retained for a limited period for security and abuse-investigation purposes, then purged
  • Data center visitor logs are retained for facility security and audit purposes

6. Data Center Physical Security

Our facility uses restricted access controls, visitor logging, and surveillance systems to protect both physical infrastructure and any personal data collected during facility visits or colocation servicing. Visitor and access data is used strictly for security and audit purposes and is not used for any other purpose without your knowledge.

7. Your Rights Under the DPDPA

You have the right to:

  • Access a summary of the personal data we hold about you and how it is processed
  • Request correction of inaccurate or incomplete data
  • Request erasure of your personal data, once it's no longer needed for the stated purpose
  • Raise a grievance about how your data is handled
  • Nominate another individual to exercise these rights on your behalf, in the event of death or incapacity

To exercise any of these rights, email support@vyomcloud.com with the subject line "Data Rights Request." We respond within 30 business days.

8. Children's Data

Our Services are intended for use by individuals aged 18 and above. We do not knowingly collect personal data of children, and we do not process children's data for tracking, behavioral monitoring, or targeted advertising.

9. Data Security

We employ reasonable technical and organizational safeguards — encryption in transit, access controls, and monitoring — to prevent unauthorized access to, or use, modification, disclosure, or destruction of, your data. In the event of a personal data breach, we will report it to the Data Protection Board of India and affected users as required under Section 8(6) of the DPDPA.

12. Complaints to the Data Protection Board

We may amend this Privacy Policy from time to time. Material changes will be communicated via the website or email. The "Last updated" date at the top of this page reflects the latest revision.
